1. Eligibility

• Reverse engineer, decompile, or attempt to extract source code from our applications

• Interfere with or disrupt the operation of our Services
• Harass, threaten, or harm other users of our Services

3. Intellectual Property

3.1 Our Ownership

All content, materials, training programs, design assets, software, trademarks, and other intellectual property provided through our Services are owned by Patrick Resendiz or our licensors. These Terms do not transfer any ownership rights to you.

3.2 Your Content

You retain ownership of original content you create and post through our Services. By posting content to our community or Services, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating our Services.

3.3 Feedback

If you provide suggestions, feedback, or ideas regarding our Services, you grant us a perpetual, royalty-free license to use such feedback to improve our Services without any obligation to you.

4. Third-Party Platforms

4.1 Platform Dependencies

Some of our Services operate within or integrate with third-party platforms (such as Canva, Circle, or others). Your use of those platforms is subject to their respective terms of service and privacy policies.

4.2 No Endorsement

References to third-party products, services, or brands within our Services do not constitute endorsement by those third parties.

4.3 Availability

We are not responsible for the availability, performance, or functionality of third-party platforms.

5. Community Guidelines

When participating in our community, you agree to:

• Treat other members with respect
• Not post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Not spam or post unsolicited promotional content
• Not impersonate others or misrepresent your affiliation
• Not share confidential information from paid programs with non-members
• Follow any additional guidelines posted within the community

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines.

6. SMS Communications

6.1 Consent to Receive Messages

By providing your phone number and opting in to receive SMS messages, you consent to receive automated text messages from Patrick Resendiz at the phone number you provide. Message types may include appointment reminders, follow-up communications, and promotional messages, depending on your selections.

6.2 Message Frequency

Message frequency varies based on your interactions with our Services. You may receive messages related to inquiries, appointments, or promotions you have opted into.

6.3 Opt-Out

You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and will no longer receive SMS messages from us unless you opt in again.

6.5 Costs

Standard message and data rates may apply depending on your mobile carrier and plan. We are not responsible for any charges from your carrier.

6.7 Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

7. Payments and Refunds

7.1 Fees

Certain Services require payment of fees. All fees are stated at the time of purchase and are processed by third-party payment providers.

7.2 Subscriptions

For subscription-based Services, your subscription will automatically renew unless canceled before the renewal date. You may cancel at any time through your account settings.

7.3 Refunds

Refund policies vary by Service and are specified at the time of purchase. Digital products and accessed training content are generally non-refundable.

8.2 No Professional Advice

Our Services provide educational content and design tools. They do not constitute professional architectural, engineering, construction, or legal advice. You are responsible for ensuring your work complies with applicable codes, regulations, and professional standards.

8.3 Results Not Guaranteed

We make no guarantees regarding specific results, income, or outcomes from using our Services. Your results depend on your own efforts, skills, and circumstances.

8.4 Availability

We do not guarantee uninterrupted or error-free access to our Services. We may modify, suspend, or discontinue Services at any time without notice.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER
• WE ARE NOT LIABLE FOR ANY DAMAGES RESULTING FROM YOUR RELIANCE ON CONTENT, INFORMATION, OR MATERIALS ACCESSED THROUGH OUR SERVICES

10. Indemnification

You agree to indemnify, defend, and hold harmless Patrick Resendiz and our affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or post through our Services

11. Termination

11.1 By You

You may stop using our Services at any time. To cancel a membership, follow the cancellation process in your account settings or contact us.

11.2 By Us

We may terminate or suspend your access to our Services at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.

11.3 Effect of Termination

Upon termination:

• Your license to use our Services ends immediately
• You lose access to membership-only content and features
• Provisions that by their nature should survive will continue, including Sections 3, 8, 9, 10, and 12

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at patrick@patrickresendiz.com to attempt to resolve the matter informally.

12.2 Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

12.3 Jurisdiction

Any disputes not resolved informally will be resolved in the state or federal courts located in Sangamon County, Illinois, and you consent to the personal jurisdiction of such courts.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our Services.

13.2 Modifications

We may modify these Terms at any time. Material changes will be communicated through our Services or via email. Your continued use after modifications constitutes acceptance of the updated Terms.

13.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

13.4 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

13.5 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
