Design Services Terms
These terms apply to kitchen, bath, and room design services booked with Patrick Resendiz. They cover what your project includes, how it is paid for, and what each of us is responsible for.
By booking your project, you agree to these terms.1. Payment
Full payment is due when you book. Payment reserves your place in my Project Queue and holds design time for your project, so fees are non-refundable once your project is booked.
2. Project Scope
My service covers the design of cabinetry-based spaces such as kitchens, bathrooms, pantries, mudrooms, and laundry rooms. That includes layout, cabinetry, appliances, and fixtures within each room you book. Projects are priced by room, as shown on your proposal.
I plan colors and finishes as part of the overall design. Specific product selections are included at my discretion, and I do not source, purchase, or guarantee specific products.
3. Plans and Measurements
I design from the dimensioned floor plans or room scan you provide. As part of your initial design, I review the layout of your floor plan and may suggest changes to interior walls, windows, and doors where they affect the design. Any change is yours to approve and confirm with your builder or architect. Exterior walls stay as drawn, and I do not evaluate structure.
You are responsible for the accuracy of the plans, scans, and dimensions you provide.
4. How Your Project Runs
After booking, you send your plans, photos, and notes on your project page, and we review them together on a short call. Your project page is the record of your design preferences, finishes, and appliances.
I give you an expected timeline for your initial design on our review call, based on the number of rooms and my current schedule.
Your project is finished in a live design session on Zoom, held after your initial design is delivered. We review your design together, and I make edits in real time. Larger projects may need more than one session, which we schedule together.
5. Your 3D Tour
Your design includes an interactive 3D tour. Rooms you book are fully designed. Any other rooms shown are not designed unless you add them to your project.
6. Adding Rooms
You can add rooms at any time. Added rooms are paid for when you add them and follow these terms. I fold them into your project and sessions based on where your project is when you add them.
7. Changes to Your Design
Changes are made live during your design session, within the layout and design direction we have agreed on. There is no separate revision round.
Changes requested after your final files are delivered, and any new layout, reoriented space, or new design direction, are new design work and are quoted separately.
8. Deliverables
Your final deliverables typically include:
- Interactive 3D tour
- Dimensioned floor plan
- Cabinetry plans and elevations
- Photorealistic renderings
Final files are delivered after your design session, in a private gallery you can share with your contractor.
9. Rescheduling
Your design session reserves time in my Project Queue. You may reschedule a session once with at least 24 hours' notice. After that, or if a session is missed, your session moves to my next available opening.
10. Drawings, Dimensions, and Exclusions
All plans and elevations are for conceptual design purposes only and are not construction documents. Dimensions are included for design reference and follow the conventions below. You are responsible for working with licensed professionals to produce construction-ready drawings and for field-verifying all dimensions before fabrication or installation.
10.1 Dimensioning Conventions
Drawings follow my standard dimensioning conventions. Unless noted, base cabinets are assumed to be 36 inches high including countertop and 24 inches deep, wall cabinets 12 inches deep, and toe kicks 4 inches high. Not every element is dimensioned, including cabinet interiors, shelving, molding widths, filler gaps, and the exact locations of outlets and plumbing fixtures.
10.2 Materials and Finishes
Renderings are representational. Expect variations in color, texture, and lighting from real-world products. Paint colors are approximated from the manufacturer and color name you provide.
10.3 Exclusions
Unless otherwise agreed in writing, I do not provide structural, engineering, or construction documents; structural or code review of your floor plan; on-site measurement or supervision; electrical, plumbing, or HVAC layouts; product sourcing or purchasing; or furniture, decor, or soft goods.
11. Communication
You can reach me by text or email with questions during your project. Plans, photos, and files can be sent by email or through your project page, and your final deliverables are shared in a private gallery.
By providing your phone number, you agree to receive text messages about your project, including scheduling and follow-ups. Message and data rates may apply. Reply STOP to opt out at any time.
12. Ownership, Privacy, and Portfolio Use
The designs, drawings, renderings, and files I create remain my intellectual property and are licensed to you for use on your project. You may share them with your contractor, cabinet maker, architect, and anyone else working on your project.
I may share renderings and 3D tours from your project on my website, portfolio, and social media. I never share your address or contact details.
13. Timelines
All timelines are estimates, not guarantees, and assume prompt communication and complete submissions. Delays in plans, materials, or feedback extend your project schedule, and I pick your project back up as my schedule allows.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- I WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM MY DESIGN SERVICES, INCLUDING COSTS OF CONSTRUCTION, FABRICATION, INSTALLATION, OR CORRECTIONS
- MY TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR PROJECT WILL NOT EXCEED THE FEES YOU PAID FOR THAT PROJECT
15. Disputes and Governing Law
Before filing any formal dispute, you agree to contact me at patrick@patrickresendiz.com to try to resolve the matter informally.
These terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes not resolved informally will be resolved in the state or federal courts located in Sangamon County, Illinois, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
I may update these terms from time to time. The terms posted when you book apply to your project. If any part of these terms is found unenforceable, the rest remains in effect.
